Plain-English Summary
BarnMatch is a beta/pilot coordination platform for animal owners, hosts, organizations, and emergency or temporary animal-placement support. BarnMatch does not provide emergency services, veterinary services, transportation, animal care, boarding, payment processing, insurance, background checks, or guaranteed matches. Animal and emergency activity involves serious risk. To the maximum extent permitted by law, users assume those risks and release BarnMatch and its current or future operator(s) from claims connected to use of the Service, including claims based on ordinary negligence where legally waivable. Users are responsible for deciding whether any host, animal owner, organization, facility, emergency information, transportation option, or arrangement is safe and appropriate. Do not show up at any host property without same-day confirmation from the host and permission to enter.

1. Agreement to These Terms
These Terms & Conditions (the “Terms”) are a legal agreement between you and BarnMatch, the BarnMatch application and website, and its current or future operator(s) (“BarnMatch,” “we,” “us,” or “our”). BarnMatch is currently made available through https://barnmatch.southification.com, but these Terms also apply to any future BarnMatch website, mobile application, subdomain, or related online service that links to these Terms (collectively, the “Service”).
By creating an account, accessing the Service, clicking “I agree,” using BarnMatch, submitting information, creating or accepting a match request, joining an organization, messaging another user, listing animals, listing host capacity, listing storage or transportation resources, or otherwise using the Service, you agree to these Terms.
If you do not agree, do not use BarnMatch.
2. Beta / Pilot Service; No Corporate Entity Representation
BarnMatch is currently a beta/pilot application. Features, data structures, matching logic, organization tools, emergency workflows, notifications, and availability may change at any time.
BarnMatch may currently be operated before formation of a separate corporation, nonprofit, limited liability company, or other legal entity. References to “BarnMatch,” “we,” “us,” or “our” mean the Service and its current or future operator(s). If a company, nonprofit, limited liability company, foundation, association, or other entity is later formed or designated to operate BarnMatch, you agree that these Terms may be assigned or transferred to that entity to the fullest extent allowed by law.
Nothing in these Terms creates a partnership, joint venture, agency, employment relationship, fiduciary relationship, rescue service, emergency response relationship, boarding facility relationship, transportation provider relationship, veterinary relationship, or animal-care relationship between BarnMatch and any user.
3. What BarnMatch Does and Does Not Do
BarnMatch is a coordination and communication tool. It may help users:
- create profiles;
- add animals or livestock that may need temporary hosting;
- add host locations, emergency shelter locations, trailer storage, equipment storage, feed storage, staging areas, or transportation availability;
- join and create organizations;
- communicate with other users;
- view potential match counts or recommendations;
- create, request, accept, decline, or coordinate matches;
- receive reminders to update availability;
- receive organization or emergency-related notices;
- report problems, spam, safety concerns, or inaccurate information.
BarnMatch does not undertake any duty to rescue, evacuate, inspect, supervise, monitor, verify, police, insure, protect, transport, board, feed, care for, or control any person, animal, property, vehicle, facility, organization, emergency event, or user arrangement. BarnMatch does not:
- provide emergency services;
- replace 911, local emergency services, animal control, law enforcement, fire agencies, evacuation authorities, or veterinary professionals;
- guarantee that emergency information is accurate, complete, current, or official;
- guarantee that any host, animal owner, organization, transport provider, resource provider, facility, shelter, or match is safe, suitable, available, lawful, insured, or appropriate;
- inspect, certify, audit, verify, or approve facilities unless expressly stated in writing;
- provide animal boarding, animal care, veterinary care, feed, transportation, waste disposal, rescue, evacuation, insurance, payment processing, or dispute resolution;
- guarantee the behavior, health, temperament, training, vaccination status, ownership, identity, capacity, property condition, honesty, or reliability of any user or animal;
- perform background checks unless a separate background-check feature is later added and expressly identified;
- act as a party to any arrangement between users.
4. Emergency Disclaimer
BarnMatch is not an emergency service. In any immediate emergency, call 911 or follow instructions from local emergency services, law enforcement, fire agencies, animal control, public officials, or other official emergency sources.
Emergency events, emergency zones, emergency notices, safety buffers, match recommendations, host availability, animal-owner needs, organization alerts, and user-submitted emergency information may be incomplete, delayed, outdated, inaccurate, or unavailable. BarnMatch may rely on user-generated content, organization-admin content, manually entered zip codes, estimated locations, or approximate matching logic.
You are responsible for independently checking official emergency sources and deciding whether travel, evacuation, sheltering, animal movement, property access, or any other action is safe and lawful.
Do not go to a host property, shelter location, staging location, or private address unless the host or authorized organization representative has given same-day confirmation and permission to enter.
5. Eligibility; Adults Only
You must be at least 18 years old to create an account or use BarnMatch. Minors may not create independent accounts, message users, arrange animal hosting, offer hosting, share contact information, or coordinate placements through BarnMatch. A parent or legal guardian may use BarnMatch on behalf of a minor where lawful and appropriate.
By using BarnMatch, you represent that you are at least 18 years old and legally able to enter into these Terms.
6. Accounts, Verification, and Security
You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for activity under your account.
BarnMatch may require email verification, phone verification, two-factor authentication, or other account-security steps. You agree not to create false accounts, impersonate anyone, use another user’s account, misrepresent organization affiliation, or interfere with account-verification systems.
Notify BarnMatch immediately if you believe your account has been compromised.
7. User Profiles and Location Information
BarnMatch may require city, state, and zip code for user profiles, animal records, host records, organization records, emergency shelter records, or resource listings. Exact addresses are generally required only for host locations or emergency shelter locations and are treated as private information.
Animal locations may differ from a user’s residence. Host locations may differ from a user’s profile location. Resource locations may differ from both.
Approximate location information may be used for matching, emergency event logic, organization coordination, and notification targeting. If exact latitude/longitude is unavailable, BarnMatch may rely on city, state, zip code, approximate distance bands, or other imperfect location methods.
8. Organizations
BarnMatch allows users to create, discover, join, and administer organizations. Organizations may include animal clubs, barns, community groups, nonprofits, emergency-preparedness groups, informal networks, facilities, associations, or other groups.
A user who creates an organization may become the organization owner or administrator. Organizations may be active immediately, but BarnMatch may suspend, remove, restrict, rename, review, or moderate organizations that are fake, illegal, abusive, spam, misleading, unsafe, infringing, inappropriate, or otherwise inconsistent with these Terms.
Organizations may have open membership, approval-required membership, invite links, administrators, operating cities, website links, emergency events, emergency shelter locations, resource listings, or other features.
Organization administrators are responsible for their own conduct and decisions. Organization administrators are not BarnMatch agents, employees, emergency responders, or representatives unless BarnMatch expressly states otherwise in writing.
9. Organization Administrators and Phone Visibility
Organization administrators may coordinate matches, manage memberships, create emergency events, and view certain organization-related status information. They may not read private user-to-user messages unless such content is specifically reported and made available through a moderation or safety workflow.
Phone numbers are not automatically visible to organization administrators. A user may choose whether to allow organization administrators to see the user’s phone number. BarnMatch may support global, per-organization, emergency-only, or match-specific phone-sharing preferences.
If you choose to share your phone number with an organization administrator, you understand that the administrator may use it to contact you about organization activity, emergency events, match coordination, or related matters.
10. Cross-Organization Matching
BarnMatch may support matching across organizations. Cross-organization matching can be powerful during emergencies and regional resource shortages, but it also requires responsible use.
Users and organizations may be able to set preferences limiting match visibility, requests, or coordination to selected organizations, organization members, verified users, or broader cross-organization pools. BarnMatch does not guarantee that organization affiliation, cross-organization status, membership approval, or administrator review makes a user safe, suitable, or trustworthy.
11. Animal Records and Animal Owner Responsibilities
Users may add animal records for horses, mules, donkeys, cattle, dogs, cats, goats, sheep, pigs, chickens, or other supported animals. Basic animal information may include animal type, count, approximate size, age, sex/status where relevant, city/state/zip, transportation needs, emergency/non-emergency need, and basic notes.
Before a match is approved or accepted, BarnMatch may require additional information such as medical needs, behavior, special handling, feed requirements, vaccination or health notes, stallion or intact status, fencing needs, separation needs, quarantine concerns, emergency contacts, or other details.
Animal owners are responsible for providing accurate, complete, and timely information about their animals. Failure to disclose behavior, medical, handling, feed, containment, or safety concerns can create serious risks and may result in account suspension, match cancellation, reporting, or other action.
12. Host Locations, Host Capacity, and Host Responsibilities
Users may add host locations, emergency shelter locations, animal hosting capacity, trailer parking, equipment storage, feed storage, water access, staging areas, transportation availability, or other resources.
Host locations may require exact address information. Exact address information is private and should not be shown to other ordinary users before both parties accept a match and agree to share contact/location details.
Hosts are responsible for accurately describing their property, capacity, animal types accepted, restrictions, availability, maximum hosting duration, access limitations, facility terms, paid/off-app expectations, and any conditions for entering their property.
Hosts may restrict capacity by animal type, housing type, stall/paddock/pasture/dry lot availability, species, stallion/intact status, behavior concerns, facility limitations, safety concerns, organization membership, verification status, or other lawful criteria.
13. Matching and Match Recommendations
BarnMatch may show potential match counts, suggested matches, match scores, match warnings, match explanations, or match recommendations. These are suggestions only.
BarnMatch may use basic rules such as animal type, capacity, location, distance, safety buffer, organization membership, user preferences, host restrictions, profile freshness, emergency status, transportation availability, resource availability, and acceptance status.
A match recommendation does not mean:
- the match is safe;
- the host is available;
- the animal owner is suitable;
- the facility is appropriate;
- the animals are healthy or manageable;
- travel is safe or lawful;
- payment terms are acceptable;
- the information is current;
- BarnMatch has verified the parties or facilities;
- anyone should enter private property.
All users remain responsible for their own decisions.
14. Match Requests and Contact Sharing
BarnMatch may allow users or organization administrators to create match requests. Organization administrators may manually create pending matches, but both users must still accept before a match is confirmed.
A match may move through statuses such as Suggested, Requested, Admin Review, Awaiting Host Acceptance, Awaiting Owner Acceptance, Accepted by Host, Accepted by Owner, Confirmed, Contact Shared, In Progress, Completed, Declined, Canceled, Expired, Emergency Reconfirmation Needed, or Host Ineligible Due to Emergency Zone.
Before contact or exact location details are shared, both parties may be asked to confirm that they agree to share certain information. Users may be able to choose whether to share phone, email, exact address, or other details.
If a match is declined, canceled, expired, completed, revoked, or otherwise closed, BarnMatch may hide previously visible private details in the app interface. Users understand that information already seen, copied, saved, screenshotted, or shared outside the app cannot be fully recalled by BarnMatch.
15. Day-of Confirmation Required
Even if a match was previously suggested, requested, approved, accepted, or confirmed, users must obtain same-day confirmation before traveling to, entering, or directing animals to a host location, emergency shelter location, staging location, resource location, or private property.
Hosts may withdraw availability at any time if conditions change. Emergencies may make prior arrangements impossible. Roads may close. Properties may become unsafe. Communication may fail.
Do not assume a prior match is still valid without day-of confirmation.
16. Messaging
BarnMatch may allow in-app messaging. Users are responsible for their messages. Messages may be private between users, except where a user reports a message, BarnMatch needs to investigate abuse, safety, spam, legal compliance, or security issues, or disclosure is required by law.
Organization administrators may see match statuses but should not be able to read private user-to-user messages unless those messages are reported or otherwise become part of a safety/moderation workflow.
BarnMatch may limit messaging, rate-limit new users, restrict abusive accounts, filter spam, allow blocking, allow reporting, or suspend messaging privileges.
17. Blocking and Reporting
Users may block or report other users, organizations, messages, listings, matches, host locations, animal records, emergency information, spam, safety concerns, privacy concerns, inaccurate profiles, bugs, payment/off-app disputes, or other issues.
BarnMatch may review reports, restrict accounts, remove content, suspend organizations, revoke access, hide listings, preserve records, or take other action. BarnMatch is not required to mediate private disputes.
18. Feed, Care, Cleanup, Waste, Transportation, and Costs
Unless the parties expressly agree otherwise, animal owners are responsible for:
- feed;
- hay;
- medications;
- supplements;
- veterinary care;
- farrier care;
- water buckets or special equipment;
- transportation;
- loading/unloading coordination;
- cleanup;
- manure and waste handling;
- damage caused by animals or handlers;
- special care instructions;
- costs and reimbursements.
Hosts may state whether feed, cleanup, waste disposal, transportation, or other services are available, unavailable, included, reimbursable, paid, or to be discussed directly.
BarnMatch is not responsible for any feed, care, cleanup, waste, transportation, veterinary, damage, payment, reimbursement, or cost arrangement.
19. Payment and Off-App Arrangements
BarnMatch does not process payments, hold funds, collect boarding fees, take commissions, provide escrow, guarantee payment, issue refunds, or mediate payment disputes.
Hosts may indicate that off-app payment, reimbursement, regular boarding, temporary non-emergency boarding, emergency reimbursement, or other paid arrangements may apply. Users are responsible for discussing and documenting any payment terms directly with each other outside BarnMatch.
BarnMatch is not a boarding marketplace, broker, payment processor, escrow service, insurer, or collection agent.
20. Transportation, Storage, Equipment, and Resource Listings
Users may list or request transportation availability, trailer storage, equipment storage, feed storage, staging areas, water access, temporary tack storage, evacuation meetup points, or similar resources.
Resource listings are suggestions and user-submitted information only. BarnMatch does not inspect vehicles, trailers, drivers, insurance, property, equipment, or resource locations. Users are responsible for evaluating safety, legality, insurance, fit, and suitability.
21. User Preferences and Safety/Comfort Preferences
Users may set preferences for organization-only requests, verified users, admin-mediated matches, direct requests, cross-organization matching, distance, housing type, facility features, host restrictions, transport, payment/off-app terms, photo visibility, communication preferences, or safety/comfort preferences.
Safety/comfort preferences may include preferences for communication, meeting arrangements, property access, handoff location, use of organization admins, or whether the user prefers to interact through verified or organization-affiliated users. Any gender-related or similar personal-safety preference should be treated as a comfort note and not as a guarantee or automatically enforceable filter unless BarnMatch implements a legally reviewed policy.
Users may not use preferences to harass, threaten, abuse, illegally discriminate, or violate law.
22. User Content, Photos, and Listings
You may submit profile text, organization descriptions, animal photos, facility photos, host descriptions, property terms, messages, emergency reports, issue reports, resource listings, comments, and other content (“User Content”).
You represent that you have the rights and permissions needed to submit your User Content and that it is accurate to the best of your knowledge. You grant BarnMatch a nonexclusive, worldwide, royalty-free license to host, store, reproduce, display, process, transmit, and use your User Content to operate, improve, protect, and provide the Service.
Do not submit content that reveals sensitive information you do not want shared, such as gate codes, private security details, license plates, minors, private addresses in public fields, or other unnecessary private information.
23. Prohibited Conduct
You agree not to:
- use BarnMatch for illegal activity;
- misrepresent identity, organization affiliation, animal ownership, capacity, availability, facility condition, emergency status, or payment terms;
- trespass or enter private property without permission;
- show up at a host location without same-day confirmation;
- harass, threaten, intimidate, exploit, stalk, spam, scam, or abuse anyone;
- use BarnMatch to facilitate animal neglect, unsafe transport, unlawful sale, theft, fraud, or cruelty;
- share another user’s private address, phone number, contact information, messages, photos, or emergency details without permission;
- upload malware or interfere with the Service;
- scrape, copy, or harvest user data;
- bypass privacy, matching, reporting, or access-control features;
- impersonate BarnMatch, an organization admin, emergency personnel, or another user;
- use the Service if you are under 18;
- violate these Terms, the Code of Conduct, or applicable law.
24. Legal Compliance and Animal Welfare
Users are responsible for complying with all applicable laws, ordinances, evacuation orders, animal welfare rules, zoning rules, transportation rules, boarding rules, facility rules, insurance obligations, public-health requirements, and property-access requirements.
BarnMatch does not determine whether your use of the Service is lawful in your jurisdiction.
25. Notifications, Email, SMS, and Reverification
BarnMatch may send account, security, organization, match, emergency, availability, reverification, reminder, and administrative messages by email, in-app notification, SMS/text message, push notification, or other channels where enabled.
Users with animal records, host records, or resource records may be asked to reverify information periodically, including every six months, after inactivity, or during active emergency events. During an emergency, hosts may be required to confirm availability before appearing as available.
Message and data rates may apply to SMS. Consent to marketing messages is not required to use the Service, but emergency or operational notices may be important to Service functionality.
26. Privacy
Your use of BarnMatch is also governed by the BarnMatch Privacy Policy. The Privacy Policy explains how BarnMatch collects, uses, shares, and protects personal information.
27. Moderation, Suspension, and Termination
BarnMatch may remove content, restrict features, suspend accounts, suspend organizations, hide listings, cancel matches, revoke access, or terminate accounts if BarnMatch believes a user or organization has violated these Terms, created risk, submitted false information, abused messaging, created spam, threatened safety, violated privacy, or used the Service improperly.
BarnMatch may also suspend or modify the Service at any time.
28. Feedback
If you provide suggestions, feedback, bug reports, ideas, improvements, or feature requests, you grant BarnMatch the right to use them without restriction or compensation.
29. Intellectual Property
BarnMatch, the BarnMatch name, interface, designs, features, software, text, graphics, logos, and other Service materials are owned by BarnMatch or its licensors, except for User Content. You may not copy, modify, distribute, sell, reverse engineer, or exploit the Service except as permitted by these Terms.
30. Third-Party Services
BarnMatch may use third-party services for hosting, authentication, database, messaging, email, SMS, maps, geocoding, analytics, storage, error logging, payments if added later, background checks if added later, or other functions. BarnMatch is not responsible for third-party services, websites, or content.
31. Express Assumption of Risk and Release of Ordinary Negligence
You understand and agree that animal ownership, animal handling, animal transportation, emergency evacuation, temporary boarding, hosting animals, entering private property, operating around trailers or livestock, relying on user-submitted information, and communicating with strangers or organization members may involve serious risks, including property damage, personal injury, animal injury, animal illness, animal escape, animal death, vehicle or trailer incidents, fire, flood, smoke, heat, hazardous road conditions, delayed communications, inaccurate information, and disputes between users.
You voluntarily assume all risks arising from or related to your use of BarnMatch, your animals, your host or resource listings, your match decisions, your communications, your property access decisions, your emergency decisions, your off-app payment or reimbursement arrangements, and your interactions with other users, organizations, hosts, animal owners, volunteers, transporters, or resource providers.
To the maximum extent permitted by law, you expressly waive, release, and discharge BarnMatch and its current or future operator(s), owners, founders, affiliates, service providers, volunteers, administrators, licensors, representatives, successors, and assigns from any and all claims arising from or related to the Service, including claims alleging ordinary negligence by any released party, except to the limited extent such claims cannot be released under applicable law.
Nothing in these Terms is intended to release claims that cannot legally be released, including claims based on fraud, willful injury, or other non-waivable conduct under applicable law.
32. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARNMATCH IS PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.” BARNMATCH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SAFETY, AVAILABILITY, RELIABILITY, AND SUITABILITY.
BARNMATCH DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, CURRENT, ACCURATE, OR AVAILABLE DURING ANY EMERGENCY.
33. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARNMATCH AND ITS CURRENT OR FUTURE OPERATOR(S), OWNERS, FOUNDERS, AFFILIATES, SERVICE PROVIDERS, VOLUNTEERS, ADMINISTRATORS, LICENSORS, REPRESENTATIVES, SUCCESSORS, AND ASSIGNS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, LOST PROFITS, LOST DATA, LOSS OF GOODWILL, PROPERTY DAMAGE, ANIMAL INJURY, ANIMAL ILLNESS, ANIMAL DEATH, PERSONAL INJURY, EMOTIONAL DISTRESS, EMERGENCY LOSSES, TRANSPORTATION LOSSES, PAYMENT DISPUTES, OR OTHER DAMAGES ARISING FROM OR RELATED TO THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, ORDINARY NEGLIGENCE, STRICT LIABILITY, STATUTE, OR ANY OTHER THEORY, EVEN IF A RELEASED PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARNMATCH’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID DIRECTLY TO BARNMATCH FOR USE OF THE SERVICE IN THE SIX MONTHS BEFORE THE CLAIM; OR (B) $100.
Some jurisdictions do not allow certain exclusions or limitations, so some limitations may not apply to you.
34. Release
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU FULLY AND FOREVER RELEASE, WAIVE, ACQUIT, AND DISCHARGE BARNMATCH AND ITS CURRENT OR FUTURE OPERATOR(S), OWNERS, FOUNDERS, AFFILIATES, SERVICE PROVIDERS, VOLUNTEERS, ADMINISTRATORS, LICENSORS, REPRESENTATIVES, SUCCESSORS, AND ASSIGNS FROM ANY AND ALL KNOWN AND UNKNOWN CLAIMS, DEMANDS, DAMAGES, LOSSES, LIABILITIES, COSTS, EXPENSES, ACTIONS, AND CAUSES OF ACTION ARISING FROM OR RELATED TO USER CONDUCT, USER CONTENT, ANIMAL HOSTING, ANIMAL TRANSPORT, EMERGENCY EVENTS, MATCHES, PROPERTY ACCESS, FACILITY CONDITIONS, PAYMENT ARRANGEMENTS, OFF-APP COMMUNICATIONS, ANIMAL CARE, ANIMAL INJURY, ANIMAL ILLNESS, ANIMAL DEATH, PERSONAL INJURY, EMOTIONAL DISTRESS, PROPERTY DAMAGE, ORDINARY NEGLIGENCE, FAILURE TO WARN, FAILURE TO VERIFY, FAILURE TO MONITOR, FAILURE TO COMMUNICATE, SERVICE UNAVAILABILITY, INACCURATE INFORMATION, OR DISPUTES BETWEEN USERS.
If you are a California resident, you waive California Civil Code Section 1542 to the extent permitted by law, which provides that a general release does not extend to claims that the releasing party does not know or suspect to exist in their favor at the time of executing the release and that, if known, would have materially affected the settlement with the released party.
35. Indemnification
You agree to defend, indemnify, and hold harmless BarnMatch and its current or future operator(s), owners, founders, affiliates, service providers, volunteers, administrators, licensors, representatives, successors, and assigns from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:
- your use of the Service;
- your animals;
- your property;
- your host location or resource listing;
- your transportation or storage arrangement;
- your User Content;
- your messages;
- your match decisions;
- your payment or reimbursement arrangements;
- your violation of these Terms;
- your violation of another person’s rights;
- your violation of law;
- your negligence, misconduct, or misrepresentation.
36. Dispute Resolution; Individual Arbitration; Class Action Waiver
To the maximum extent permitted by law, you and BarnMatch agree to attempt to resolve any dispute informally before filing a claim by contacting BarnMatch at info@barnmatch.southification.com and describing the issue in reasonable detail.
To the maximum extent permitted by law, any dispute, claim, or controversy arising out of or relating to BarnMatch, these Terms, your account, your use of the Service, any match, any user interaction, any organization activity, any emergency event, or any related arrangement will be resolved by binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court if the claim qualifies.
You and BarnMatch agree that any arbitration or legal proceeding will be conducted only on an individual basis. You waive the right to participate in a class action, class arbitration, representative action, private attorney general action, consolidated action, or jury trial to the maximum extent permitted by law.
If this arbitration or class-action-waiver section is found unenforceable in whole or in part, the unenforceable portion will be severed to the maximum extent permitted by law, and the remaining portions of these Terms will continue to apply. If arbitration is not enforceable for a particular claim, the governing law and venue provisions below apply.
37. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, unless another law is required to apply. Subject to any mandatory law to the contrary, any legal action arising from or relating to these Terms or BarnMatch will be brought in the state or federal courts located in California.

38. Changes to These Terms
BarnMatch may update these Terms from time to time. The updated version will be posted in the Service with a new effective date. Continued use of BarnMatch after changes become effective means you accept the updated Terms. BarnMatch may require you to accept updated Terms before continuing to use the Service.
